Palm CEO claims ‘no issues with Apple’ over iPhone patents

"Palm doesn't expect there to be any disputes with Apple over patents for multi-touch technology in webOS or the Pre smartphone, company chief Ed Colligan said today at the Thomas Weisel Technology & Telecom Conference. The executive believes there are 'no issues with Apple' iPhone patents and says that Palm is 'very respectful' of other companies' intellectual property, preferring to dodge around conflicts altogether rather than setting itself up for a challenge. Palm has about 1,500 patents that Colligan is confident gives his company a safe foundation," Electronista reports.

"Apple has provided mixed signals over its own actions, prompting fears that the company might sue Palm for alleged patent infringement and scuttle the Pre before it ships. Company operations chief Tim Cook has consciously avoided implying that Palm is violating patents but has also said Apple 'will not stand' for any perceived theft of its intellectual property," Electronista reports.

"No clues are given about the price of the Pre, though Colligan appears to have partly backtracked from previous statements suggesting that the touchscreen slider would need to command a premium price," Electronista reports. "Sprint's exclusive deal for the Pre won't preclude international launches, Colligan says, while 'additional carrier partners' are also due inside the country for early 2010."

MacDailyNews Take: We've learned and struggled for a few years here figuring out how to make a decent phone. PC guys are not going to just figure this out. They're not going to just walk in. - Ed Colligan, Palm CEO, November 16, 2006, laughing off the idea of Apple entering the smartphone market.

I love how journalists conclude that since Apple has not said anything about Palm in particular (or any company in particular) then Apple must be intending to sue Palm.

How is Apple saying they will not stand for any theft of their intellectual property "mixed signals?" Because they haven't named any specific company? That's a pretty big stretch to go for "mixed signals."

Again, Apple has patent applications filed for multi-touch on mobile devices but Apple has not been granted a multi-touch patent from my research. If any of you have found a multi-touch patent owned granted in any country to Apple, list it here.

I think it's great that it's taken the Palm Pre to finally call MDN out on their BS. MDN, just realize that the Pre is just as good as the iPhone, and even better in some areas (yes, the iPhone is equally better in other areas). It's going to be OK!

Anyways, the validity of the multi-touch patent owned by Apple is INDEED in question. The technology they BOUGHT from the fingerworks owners (Wayne Westerman and John Elias) may not have been theirs in the first place. The University of Delware may be the true owners of the multi-touch technology.
At this point I would bet a dollar that Apple does not DARE try to sue palm. Unlike Google, Palm doesn't owe SQUAT to Apple.

This suing other companies for crap is how the average company operates. It should not be how Apple operates! I'm not saying that if someone has truly stolen their stuff that they should not sue. But its just that in this particular situation the legs on which their case stands on is kinda flimsy.

Apple needs to concentrate on their upcoming products and to make sure that they are better and rely on more technology that is developed in house as opposed to patents that they buy.

I would say that the signals Apple is sending are not mixed at all. On the contrary, Tim Cook is sending a message that is crystal clear. But that message has nothing specifically to do with the Pre (what a stupid name!), which isn't even out yet. It is simply a warning to the entire mobile phone industry that Apple will aggressively defend its intellectual property. And this much, at least, should be crystal clear to any "analyst" who made it past the third grade.

I hope for Ed Colligan's sake that he is familiar with the provisions of Sarbanes-Oxley. He needs to be damn sure that there are no grounds for Apple to sue. If not, he is opening himself up to a slew of lawsuits from shareholders, as well as making himself liable for civil penalties.
had he kept his mouth shut, he could have claimed no particular knowledge. By making this proactive statement, he is effectively claiming he has considered the situation and has grounds for his belief.

The "PC" guys did just walk in and figure it out, because they were NOT constrained and limited by the existing mobile phone industry mentality. They actually did not want to "figure out" what the industry was doing and copy it; they wanted to "think different" and create a product that no one else can match.

Of course, if the "PC guys" are Dell, that statement would be absolutely true.

I think what palm is saying that maybe they are infringing on apple patents, but apple is also infringing on palm'm patents (apperently thay have more than 1500 of those). So the end result will probably be that nobody gets sued. Everybody would get hurt.
