There’s a lawsuit for that: AT&T sues Verizon over misleading wireless coverage ads
Tuesday, November 03, 2009 - 04:54 PM EST

"AT&T Inc. took offense to Verizon Wireless's latest advertising campaign, claiming in a lawsuit filed Tuesday that the commercials falsely suggest the wireless carrier has coverage gaps," Roger Cheng reports for The Wall Street Journal.

"Verizon Wireless, which is jointly owned by Verizon Communications Inc. and Vodafone Group Plc, has jumped on mounting criticism of AT&T's coverage and its ability to handle the Apple Inc. iPhone with its recent commercials, which target AT&T's high-speed third-generation, or 3G, network," Cheng reports.

"The 'There's A Map For That' commercials mock Apple's own 'There's An App For That,' television spots, which tout the thousands of programs found on its smart phone," Cheng reports. "But in a lawsuit, AT&T said the Verizon commercials mislead consumers about the scope of its coverage by using maps with large amounts of blank space, which represents the carrier's 3G coverage. AT&T contends the map suggests that the blank spots indicate the complete lack of coverage, and not just 3G. The company added that it had complained to Verizon Wireless, and minor changes had been made to the spots."

It's only subconsciously misleading, which is why they're so brilliant.

Verizon states very clearly, with both on screen text and the commercial voice over, that they're specifically referencing 3G coverage. So I don't see what legal basis ATT has to stand on since Verizon made sure to cover their asses.

But subconsciously, the viewer sees those maps with the red rash choking America to death and can't help but think of how superior Verizon's network is altogether, both voice and 3G data. That's why ATT is so scared of the commercials. Bravo to Verizon, they obviously hit the mark with this one. If ATT doesn't like it then they need to fill in their map and quit bitching.

Nov 03, 09 - 05:04 pm Comment from: covered

Maybe AT&T;could take the money their spending on lawyers and increase their 3G coverage area?

Nov 03, 09 - 05:05 pm Comment from: HMCIV

I can see the pre-trial deliberations now. All the AT&T;attorneys have iPhones. All the Verizon lawyers have Blackberries.

Verizon lawyer: Can...um... can I look at, just for a sec?

AT&T;lawyer: No.

MDN - Ha! Ha! One of your best titles yet.

Peace.

Nov 03, 09 - 05:08 pm Comment from: free market

Just go with a dual carrier in the US and let the people vote with their wallets and feet as to who they want to provide their iPhone coverage. Enough already.

Nov 03, 09 - 05:09 pm Comment from: Eric

There's a lawsuit for that! Brilliant!

If AT&T;is going to leave us with crappy coverage, the least they could do is hurry up with the Microcell rollout in Los Angeles.

Nov 03, 09 - 05:11 pm Comment from: 84 Mac Guy

@HMCIV

Good one. That's probably how it will play out.

Nov 03, 09 - 05:20 pm Comment from: pwntbywombat

Verizons best add campaign...ever. Att has no legal basis because it clearly states 3G COVERAGE, not VOICE. Bravo to Verizon.

Nov 03, 09 - 05:25 pm Comment from: NCG598

This explains it, if anyone has questions.

Good luck, AT&T--I think you'll need it.

The ad clearly states 3G coverage. The voice-over clearly states 3G coverage. And the reality is that, if you want 3G coverage, you won't get it in those areas, just like the ad says. I don't think there's anything misleading about it, so showing those areas as empty is perfectly legitimate. The fact that you could EDGE instead of 3G in the other areas is neither here nor there.

That said, I live in one of those nice blue areas and have had no complaints with AT&T's service.

Nov 03, 09 - 05:32 pm Comment from: Think twice

Fools, let me repeat, only FOOLS believe commerials without checking out the INFORMATION!

Dumbass retards!

Verizon: Hey, can I call you back? I have to check out the website. Since I do not have the iPhone that allows me to talk and surf the Internet on my crappy Verizon Droid phone at the SAME DAMN TIME!

Nov 03, 09 - 05:35 pm Comment from: brandon

Yes, Bravo to Verizon for blowing the iPhone deal in the first place. Now that they are bleeding high end customers, the are getting desperate. I was with Verizon for 5 years, AT&T;since the iPhone has come out and have had a great experience with AT&T;.

Nov 03, 09 - 05:37 pm Comment from: SamLowry

where on this planet does CDMA work?
there's a map for that, too.

Nov 03, 09 - 05:43 pm Comment from: NCG598

I think on the Verizon network they uses the older system where you can only talk or surf the Internet.

ATT uses the newer system that allows you to do both- talk and surf at 3G.

I suppose it is a trade off at the moment, at lest untill ATT continues to roll out there newer system and Verzion begins to add small market coverage with there matching system.

Verizon will have poor Gsm coverage when they start to roll out in 2011. ATT will have the superior GSM system then.

Nov 03, 09 - 05:45 pm Comment from: Beowulf

@ SamLowry

CDMA works great where I am. Which is Colorado. It also works great in Nebraska, Iowa, California, Kansas, South Dakota, Florida, Arkansas, Georgia...should I go on?

And maybe I just suck at multi-tasking, but I have never had a need to talk on my cell and surf the net or text at the same time.

Nov 03, 09 - 05:45 pm Comment from: Roberto

A T & T AT&T;

Nov 03, 09 - 05:55 pm Comment from: MPC Guy

AT&T;'s claims are even more misleading. In Seattle, 3G wireless coverage includes the city and surround burbs.

In the city, 3G speeds vary widely despite being at full signal or not. Sometimes, shutting down 3G and getting data over Edge actually speeds things up.

About 5 miles away (and still within AT&T;'s coverage map), 3G speeds and connectivity get even worse. I'm talking Bellevue and Kirkland for those familiar with the Seattle area.

AT&T;'s 3G network is a complete joke - in Washington at least.

---
This is my experience using iPhone and iPhone 3G. Friends report the same.

Nov 03, 09 - 06:03 pm Comment from: jfort

I live in one of AT&T;'s voids -- NW Ohio. Poor cell coverage, no 3G. I hate it that I have to carry a Verizon phone (my old Treo) in addition to my beloved iPhone just so I can make a call in many places. AT&T;is getting what it deserves.

Nov 03, 09 - 06:04 pm Comment from: @BEOWOLF

Yes, many apps including the banking, apps that receive information for live data all require connection.

Perhaps you should try muti tasking on the iPhones 3G network. Drop the "iDon't" System that you are leashed to.

Bet you can not wait to get GSM from Verizon. But they have a map for that too. It is just empty and blank. ATT leading into where Verizon can only follow.

Beowolf, for those whom have not use for doing more than one thing at a time- try not to impose your limited abilities as a stanard we give up years ago.

grin

Nov 03, 09 - 06:07 pm Comment from: R2

ATT is the one who should be sued for false advertising. They've hid behind the confusing shades in their coverage map for years now.

What ATT does is show voice coverage in a lighter hue of blue/orange while mixing in the darker shade that represents 3G coverage. So basically you look at their map and see blue/orange all across the country without easily distinguishing the difference. They don't have separate maps because it would be a devastating picture.

http://cache.gawker.com/assets/images/gizmodo/2009/11/AT_T_coverage_map.jpg

So Verizon did it for them. They stripped out the light blue and left the dark blue, which is actually the more realistic representation of ATT 3G coverage. Then, fairly, Verizon did the same thing for their own map... but it's still blanketing the country in red even without the voice coverage!

ATT is shitting bricks because their 3G coverage map is a sham and Verizon blew the whistle on their whole operation. And notice how Verizon makes sure to show the ATT customer with an iPhone, frustrated at their lack of signal. It reinforces the idea that iPhone customers are signed up with ATT despite the abysmal network and they'd jump to Verizon in a hurry if given the chance. ATT better pray that it's never given to them.

Nov 03, 09 - 06:07 pm Comment from: twilightmoon

Beuwulf

you don't suck at multitasking, you simply are unable to. If you even moderately use an iPhone for communicating you'll have plenty of uses for voice and data together.

Examples
Looking up movie times
checking directions
checking and confirming information from emails and SMS.

Those are just a few of the more common ones.

Verizon has an obsolete and primitive crippled network paired with crippled hardware, bad customer service and rip off nickel diming BS. AT&T;is not perfect but they are saints by comparison.

I'll grant they could build put their network more but the same could be said for all US carriers. True having iPhones on mire networks would give people more choices but until Verizon fixes their crippled obsolete network they make a very poor choice. That's not to mention their obsession with controlling phone hardware and selling crippled junk that tries to nickel and dime their sucker.. I mean customers.

Nov 03, 09 - 06:09 pm Comment from: Mac Daddy

OK, so Verizon's got more 3G coverage. But look at the crappy screen, and that crappy little keyboard, that the Verizon dude is stuck with!

Nov 03, 09 - 06:14 pm Comment from: January 24, 1984

Yep, just checked my iPhone: No Service.

Pretty much unusable in my office.

Had a Verizon phone for ages. Never had any connection problems.

Nov 03, 09 - 06:19 pm Comment from: Come to daddy!

@ Beowolf,

Dude! Got a girl friend? You would, like, really use the data and talk. It's, like, totally cool to do more than one thing, try it out or are you, like, 12 years old with your parents old phone?

Like chill on the tude man!

Nov 03, 09 - 06:20 pm Comment from: Brau

The ads appear to be targeting a comparison to the iPhone more than AT&T;with their skew on "there's an app for that". It seems the main message is to suggest the Droid phones are just as capable as an iPhone and have as much developer support. The coverage claims only get glossed over at the end.

Just another "Me Too" product, just like the Win7 ads, conclusively suggesting Apple is the target to beat.

Nov 03, 09 - 06:21 pm Comment from: Rob

They claim 5 times more coverage, but when you compare the maps, looks like 10 times more, so the ads or the maps are misleading.

Nov 03, 09 - 06:23 pm Comment from: Moo

@R2;

Actually, it's Verizon that should be sued for false advertising.
Not only does their map claim 3G coverage where there is none, I've been to places they show where you get no coverage at all.
I was ROAMING in areas Verizon claimed they covered, so in my book, they're lying.

Nov 03, 09 - 06:26 pm Comment from: BDD

Once you fall off of Verizon's 3G you lose Voice & Data. Fall of of AT&T;'s 3G you still have voice and EDGE. EDGE is almost everywhere so the iPhone works almost anywhere. I travel many place there is NO Verizon at all ... no data, no voice, no service....

Nov 03, 09 - 06:27 pm Comment from: HughB

The speeds of most of Verizon so called 3G are actually slower than some EDGE area. Just comparing their so called 3G to AT&T;real 3G is misleading. Just sayin'

Nov 03, 09 - 06:28 pm Comment from: SamLowry

@Beowulf
or should I call ya Truman,
sad to see you never left the US.

Nov 03, 09 - 06:35 pm Comment from: Traveler

From reading this article with the comments- noticed a few Verizon staff or just annoying idioits that attempt to raise someones anger. Stupid is as stupid does.
I travel both in the US and international for that matter. I find I am much better off using the iPhone. There is a lot of area ATT DOES NOT WORK. IT IS THE SAME FOR VERIZON- sorry not yelling, just highlighting a point.
But, Starbucks, McDonalds, Panera and a thousand other locations that ATT has wifi, not excluding airports, I get for free. And that is faster than 3G.
I also use VOIP to call out side the US. Verizon is issued by the company is used a lot less just for those reasons.
In a dead area- find a Starbucks or the like and start talking. I wholly disagree with these Verizon advocates. They probably use the network very little or never had the choice or never had ATT.
I have both and in the mix ATT gives a lot more that allows me to operate cheaper and with solid results.

Regardless, I get more on the ATT network even when neither ATT or verizon cell service works. It is called free WIFI- here and overseas. Just my experience (network admin).

Nov 03, 09 - 06:41 pm Comment from: NCG598

Proof that Verizon CDMA is much larger than ATT GSM network.

AT&T

You have to use the HTML code for ampersand which is, ironically, the ampersand sign followed by amp;

If you sandwich that between AT and T, then you will get AT&T

Nov 03, 09 - 06:44 pm Comment from: KingMel

Take all technical specifications with a large grain of salt, or a whole shaker of salt, for that matter. But coverage does matter - fast or slow. And slow is generally a whole lot better than none (which is why we tried and dropped Sprint many years ago - we could not achieve a reliable connection from our home).

@ Beowulf
"And maybe I just suck at multi-tasking, but I have never had a need to talk on my cell and surf the net or text at the same time."

You have to be kidding right?
Like when are talking and want to look up a street location or che check the weather before making an appointment or check current delivery or inventory before telling a client "no problem" or check flight arrivals (without saying "hold on I'll call you right back after I check")

You Apple hater are a trip... blinders on much, CDMA is horribly flawed that is why verizon is dropping it.

Nov 03, 09 - 07:21 pm Comment from: doc

Someone tried to tell me that Apple and Verizon were not competitors, but from this ad it looks a lot like Verizon seems to think so.

Service in my area is spotty on the ATT net (ATT rates it as good, but good isn't good enough). I would love to use an iPhone. What I want to know is when does Apple plan to buy Verizon? Apple has a market cap that is twice that of Verizon. Heck, Apple could likely pay cash for Verizon if they offered to pay off, with stock issues, the 62 billion with a "B"debt Verizon carries on the books.

Nov 03, 09 - 09:09 pm Comment from: Marian

Verizon's network is like having broadband internet at home and not having a computer.

What good is the network for if you have only crappy phones?

Nov 03, 09 - 09:35 pm Comment from: Bill

I do not know what AT&T;is going to prove other than their network sucks. The iPhone is great. It is funny, I am considering a Sprint MiFi unit so that I can surf the net with real speed instead of the EDGE network. The crackberry is enticing if for no other reason than I can actually use a real 3G network. There is nothing more awesome than pulling your iPhone 3G out and people comment how slow it is in loading a webpage or checking mail, while they pull out there Verizon or Sprint crackberry and connect at high speed. Apple got the iPhone right, but got the network wrong.

Nov 03, 09 - 11:38 pm Comment from: mintdog

ATT thinks it is misleading because of their own underlying insecurity about the fact that their coverage sucks. We all know that an iPhone on any other network would be way better.

Nov 04, 09 - 01:05 am Comment from: treestman

While the Verizon map is labeled 3G, and the announcer says it as well, the "Bench" commercial clearly shows the AT&T;girl missing the social at the bistro.

The only way she'd miss the gathering is if she didn't get the call, email, text, whatever to meet there. EDGE would work fine for that, so the implication is absolutely that no 3G = NO COVERAGE. It's incredibly misleading.

Nov 04, 09 - 08:12 am Comment from: silverhawk

The ATnT map shows nothing for Alaska. Anyone been up there lately and used the iPhone?

Nov 04, 09 - 08:29 am Comment from: bobchr

AT&T;does not have a 3G specific coverage map on their web site so it's questionable where the source of Verizon's information comes from. With the rapid build out of AT&T;'s 3G expansion Verizon's implied representation of AT&T;'s coverage has to classified as suspect at best if not outright slander. I've had 3G speeds on my IPhone that rivals and often surpasses Cablevision's wifi speeds at LIRR train stations.

Nov 04, 09 - 09:51 am Comment from: @Silverhawk

I thought i used my iPhone in 3G mode in Anchorage. AT&T;purchased Cellular One up there a few years back and has excellent coverage in populated areas and roadways connecting towns and cities on the major highways (at least as good as Verizon). I'll note that I couldn't use my work Blackberry from Verizon the last time I tried (over a year ago - just stopped taking it, it may work now).

Nov 04, 09 - 09:53 am Comment from: Map Quest

Nov 04, 09 - 10:04 am Comment from: @Bill (the brainless)

Yea Bill- you are right.

You know the reason. Your stupid company TURNED apple down! You could have had the iPhone on Verizon but the idioits thought they knew better!
Hey, even the CEO admitted it. Ask your customer rep why Verizon did such a stupid thing.

Yep, Apple offers and Verizon said- no thinks!

Simple google search to find The answer to that question.

Nov 04, 09 - 10:50 am Comment from: @R2

Hey, should ATT have a commerical of "idon't" know why we turned down the iPhone? We had first chance at having what Apple was covertly working on. But, no- we choose not too. Maybe we are turning down all sort of rings that would benefit our customers right now but will not allow because they break our control over the freedom to choose.

Sorry, what you do not know will never bug ya. I didn't choose the iPhone and "iDon't" care network. Can you hear me now?

Nov 04, 09 - 11:03 am Comment from: bizlaw

I'm sure both maps are wrong to a certain degree, because it's Verizon's commercial and a sparse ATT map compared to a full Verizon map only benefits Verizon.

The fact remains that you can't buy an iPhone on Verizon's network. And no matter how many maps or commercials Verizon puts up, that fact ain't changing.

Ads like this will keep Verizon iPhone-less for quite some time. Steve Jobs will make sure of it.

Nov 04, 09 - 01:44 pm Comment from: Hugh Jass

AT&T;claims; "ads are causing "incalculable" market share loss"

Boo hoo hoo... poor AT&T;.... losing 3G customers to Verizon that you can't calculate? - Maybe there's an app for that!... LMAO!

LOSERS!

Nov 04, 09 - 04:41 pm Comment from: @Hugh Jass

Cute, but the fact that Verizon has not had the iPhone and its ground breaking, and may I add, all smart phone crushing, blackberry stomping, htc kicking, and Nokia hook to the gut phone has actually placed all of Verizons smart phone users in the "LOSER" catergory.
Damn, so what does it feel to be a loser since your dumbass provider decided NOT to accept the iPhone?

LLLOOOSSSEEERRR!

Kinda hoping the next series of phoneS will help don't you! HaaaaHa- oh gawd my sides are killing me from laughing at you. Hey loser, why don't we talk and compare website bro!

Whahaaaaa- you can't! Idon't, say it again, iDon't know why!

Word- LOSER!

Wow- that felt good.

Nov 05, 09 - 11:29 am Comment from: Beowulf

@ Uncle Fester's cousin

Just so you are aware, I am not an Apple hater. I have used Apple products since the Apple II. Yes, my family owned one. We also owned an IIgs (Woz Edition), SE, SE/30, LC III, MacTV (Black Mac), Original iMac, PowerMac 9600, Powerbook 1400, PowerBook G3 Lombard, iBook and my current Macbook Pro. I've also have owned about 6 different iPods. My wife and I currently each use iPod Touches. My dad retired from Apple a year ago after working for them for 6 years in sales and still uses the original iPhone that was given to all Apple employees (with 1000 hours logged in the previous year) shortly after it was released. Just wanted to clarify that I am in absolutely no way an Apple hater. And you saying that really ticked me off. Sorry for the rant people.

Back to your response. You said "Like when are talking and want to look up a street location or che check the weather before making an appointment or check current delivery or inventory before telling a client "no problem" or check flight arrivals."

I guess you have more to do than I do. But, if you read what I wrote correctly, I said, "I" have never had to do any of these things. I don't live in my car for my job so it's not an issue for me, simple as that.

For everyone else, I wish AT&T;worked in my area well. I really do. If it did, I would probably switch from Verizon. Just for the convenience of not carrying a phone and my iPod. I seriously doubt that will ever happen though. Verizon screwed the pooch on that one. But, as it stands right now, I won't switch from Verizon simply because I have had less than 5 dropped calls in 8 years with them. My dad, who had Cingular and later AT&T;before and after he got his iPhone, has had more than I can count. Where I do travel is in "Partner" coverage. So, then I run the risk of my contract getting cancelled because I use those areas too much. Verizon suits my needs almost perfectly. Yes, I wish they'd get their heads out of their butts about their fees, but their coverage is currently still the best for what I need.

Lastly, I apologize for "offending" anyone. But, in reality, you all read WAY too much into what I said. IMHO anyway. Here's to hoping that AT&T;really goes full tilt on building out their system so that I can reliably use an iPhone!
