My theory:
Microsoft knows they are copying OS X.
In their mind, nobody significant uses OS X.
No one knows about OS X.
MSFT will not get caught because no one is familiar with the source of their copying.
MSFT thinks they own the OS market, therefore they have reign over any OS innovation.

Anybody who has used Macs for a couple decades may recall the original Apple vs. Microsoft lawsuit, which was thrown out for reasons similar to ones stated by Pogue.

The Mac has a trash can in the lower-right, while Windows implemented a recycle bin in the upper-left.

The sad thing is is that he is right - the differences between OS X and Vista are enough different that they are not the same. Google was awarded a patent on it's interface, but it is incredibly specific:

It would have been much different if Apple had a patent on menus that appear is response to a click or other user input. Unfortunately, the courts do not see the two interfaces as being similar.

Speaking as a Brit,

I think it is significant that there is an influential journalist working for a renowned newspaper in the U.S. who furthers the Mac cause - in a fair an elegant way.

Alas, the same can't be said for my home country. The BBC and The Guardian are two of many British media organizations which reveal, at best, ignorance and indifference in all things Apple, and, at worst, downright hostility.

The copying is just expected nowadays.

However, the real deal is that there is tight integration between OSX and THE HARDWARE ( PPC or INTEL). You know if you load TIGER it will run on a machine that's 6 or 8 year's old. Same as iPod and iTunes Music Store.

VISTA is only going to work on modern PC's and the biggest issue for homeowners is buying a new PC just to be able to use M$'s unoriginal software.

Actually, Apple lost the 'look and feel' lawsuit versus Microsoft not because of thee sorts of things, but because the judge ruled that Microsoft's use of the GUI was allowed under Apples (way too) broad original agreement With Microsoft.
